LET’S GO VICTORIA — TERMS OF SERVICE

These Terms of Service (“Terms”) apply to your use of the Let’s Go Victoria website, listings, marketplace and related services.
Let’s Go Victoria (“LGV”, “we”, “us” or “our”) operates an independent discovery platform for Victoria, Australia. The platform includes destination and event information, business and other listings, paid promotional services, and the Shop Local marketplace where approved third-party sellers can offer products and services to customers.
By accessing or using the website, creating an account, submitting a listing, purchasing a service from LGV, selling through Shop Local, or buying a product through Shop Local, you agree to these Terms and any policies referred to in them.
If you do not agree to these Terms, you must not use the relevant part of the Service.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law.
- ELIGIBILITY AND ACCOUNTS
You must provide accurate, current and complete information when creating an account, submitting a listing, making a purchase or applying to sell through Shop Local.
You are responsible for maintaining the security of your account and for activity carried out through it. You must notify us promptly if you believe your account has been used without your permission.
Seller accounts are available only to people and businesses that are legally able to enter into binding agreements and meet any eligibility, identity, payment-provider or verification requirements that apply.
You must not impersonate another person or business, create an account using false information, or use the Service for any unlawful or unauthorised purpose.
- LET’S GO VICTORIA LISTINGS AND INFORMATION
LGV publishes and displays information about destinations, events, venues, businesses, markets, attractions, accommodation, experiences and other places or activities.
Some information is supplied by businesses, event organisers, sellers, users, public sources or third-party providers. While we aim to keep information useful and current, details can change. Dates, times, prices, availability, accessibility information, operating hours, locations and other details should be confirmed with the relevant organiser, venue, seller or business before you travel, book or purchase.
LGV may edit, format, categorise, moderate or remove submitted content where reasonably necessary for quality, accuracy, safety, legal compliance or operation of the Service.
Submission or publication of a listing does not guarantee any particular level of traffic, enquiries, bookings, sales, search-engine ranking or commercial result.
- PAID LGV SERVICES
LGV may sell listing packages, promotional services, advertising-free promotional placements, social media services and other platform services directly to businesses or users.
Prices are shown in Australian dollars and include GST where applicable.
The inclusions, duration and price of a paid LGV service are those displayed at the time of purchase unless otherwise agreed in writing.
We may change future prices, package inclusions or services. Any change will apply prospectively and will not remove rights you have in relation to a service already purchased.
Where a paid LGV service is supplied to a consumer within the meaning of the Australian Consumer Law, applicable consumer guarantees continue to apply.
- SHOP LOCAL MARKETPLACE
Shop Local allows approved third-party sellers (“Sellers”) to offer products, vouchers, tickets, experiences, services, merchandise, local produce and other approved items (“Products”) through LGV.
Unless a Product is expressly identified as being sold by Let’s Go Victoria, the Seller identified on the Product page is the supplier of that Product.
For a third-party Seller Product, the contract for the sale of the Product is between the customer and the Seller. LGV provides the marketplace, technology and payment connection that enables the transaction.
LGV is not the manufacturer, producer, supplier or fulfillment provider for a third-party Seller Product merely because the Product appears on the website or payment is processed through the platform.
Nothing in this section limits any responsibility LGV may have under applicable law.
- SELLER APPROVAL AND MARKETPLACE ACCESS
Selling through Shop Local is subject to approval by LGV.
We may require a Seller to:
– have an eligible LGV listing or account;
– provide accurate business, contact and identity information;
– connect and maintain an eligible Stripe account;
– complete payment-provider verification;
– provide licences, registrations or other evidence where relevant; and
– comply with these Terms and any Shop Local seller requirements displayed on the website.
Marketplace access may be restricted, suspended or removed where reasonably necessary because of suspected fraud, unlawful activity, repeated customer complaints, non-fulfilment, payment risk, safety concerns, breach of these Terms, Stripe restrictions, or conduct that may materially harm customers or the platform.
Where practical and appropriate, we will give the Seller information about the reason for the restriction and any steps available to address it.
- SELLER PRODUCT LISTINGS
Sellers are responsible for the Products they list and for ensuring that each Product listing is accurate, lawful and not misleading.
A Seller must ensure that:
– they have the legal right and authority to sell the Product;
– descriptions, images, prices, availability, inclusions and exclusions are accurate;
– claims about the Product can be substantiated;
– the Product complies with applicable laws, safety standards and mandatory requirements;
– they own, or have permission to use, all images, trademarks, text and other content they upload;
– shipping, delivery, collection, booking or redemption conditions are clearly stated where relevant; and
– any limitations, expiry dates or material conditions are disclosed before purchase.
LGV may review, approve, reject, edit, unpublish or remove Product listings where reasonably necessary to operate the marketplace, protect customers, comply with law or enforce these Terms.
Approval by LGV does not transfer responsibility for the Product from the Seller to LGV.
- PROHIBITED AND RESTRICTED PRODUCTS
Sellers must not list unlawful, counterfeit, stolen, unsafe, recalled or misleading Products, or Products that infringe another person’s intellectual-property rights.
Products that are regulated or age-restricted, including alcohol and other regulated goods or services, may only be offered where expressly permitted by LGV and where the Seller complies with all applicable licensing, age-verification, advertising, delivery and other legal requirements.
LGV may prohibit or restrict additional categories where reasonably necessary for legal, safety, payment-provider or platform reasons.
- ORDERS AND SELLER FULFILMENT
Sellers are responsible for accepting and fulfilling orders for their Products, including stock control, preparation, shipping, delivery, collection, booking, redemption and customer communication.
Sellers must fulfil orders within the timeframe stated on the Product page or, where no timeframe is stated, within a reasonable time.
If a Seller cannot fulfil an order, the Seller must promptly notify the customer and take the steps required by applicable law, including providing an appropriate remedy where required.
Customers are responsible for providing accurate delivery, contact and order information.
- PAYMENTS, STRIPE CONNECT, COMMISSIONS AND PAYOUTS
Payments for Shop Local Products are processed using Stripe and Stripe Connect or another payment provider we may make available.
Sellers using Stripe Connect must comply with Stripe’s applicable terms and complete any verification required by Stripe. Stripe may impose its own restrictions, reserves, holds, payout schedules, verification requirements or account limitations.
By connecting a Stripe account to LGV, a Seller authorises LGV and Stripe to process marketplace transactions and related activity as necessary to provide Shop Local, including payment collection, commissions, transfers, refunds, reversals and dispute-related adjustments.
LGV may deduct the marketplace commission, platform fee or other amount disclosed to the Seller for the applicable marketplace service.
The commission or fee that applies is the rate displayed or agreed for the Seller’s Shop Local access at the relevant time.
Seller payouts are subject to successful payment processing, Stripe’s payout schedule, verification requirements, refunds, reversals, disputes, chargebacks and any other applicable payment-provider requirements.
LGV does not guarantee that a payout will reach a Seller’s bank account by a particular date where the timing is controlled by Stripe, a financial institution, payment network or regulatory process.
- TAXES
Each Seller is responsible for understanding and meeting their own tax obligations arising from marketplace sales, including GST obligations where applicable.
Sellers are responsible for providing accurate tax and business information and for issuing any tax invoice or receipt they are legally required to provide.
LGV may collect or report information where required by law.
- REFUNDS, RETURNS AND AUSTRALIAN CONSUMER LAW
Nothing in these Terms limits a customer’s rights under the Australian Consumer Law.
Consumer guarantees may apply to Products and services purchased through Shop Local. Those rights cannot be excluded by a Seller’s refund policy or by these Terms.
For a third-party Seller Product, the Seller is responsible for providing any repair, replacement, refund, cancellation or other remedy required by law.
A Seller may offer additional change-of-mind, exchange or refund rights. Any voluntary Seller policy operates in addition to, and does not replace, rights that apply under the Australian Consumer Law.
Customers should first contact the Seller about a problem with a Seller Product. LGV may assist with communication or marketplace administration where appropriate, but this does not transfer the Seller’s legal obligations to LGV.
Where LGV issues or facilitates a refund through the marketplace, associated Seller transfers, commissions or balances may be reversed or adjusted as part of the refund process.
- PAYMENT DISPUTES, CHARGEBACKS AND NEGATIVE BALANCES
A payment may be disputed or reversed by a customer, bank, card network or payment provider.
Sellers are responsible for providing accurate information and reasonable evidence relating to orders, fulfilment and customer communications where requested in connection with a dispute.
Where a refund, dispute, chargeback, reversal or related fee affects a Seller transaction, the relevant amount may be deducted from the Seller’s available balance, future payouts or other amounts payable to the Seller, to the extent permitted by law and the applicable payment-provider arrangements.
Sellers must not attempt to avoid legitimate refund, dispute or consumer-law obligations by withdrawing funds, closing accounts or otherwise interfering with the payment process.
- CUSTOMER RESPONSIBILITIES
Customers must provide accurate information when placing an order and must not make fraudulent purchases, misuse payment methods, abuse refund or dispute processes, or interfere with the operation of the marketplace.
Customers should review the Product description, Seller information, delivery or redemption conditions and any disclosed restrictions before purchasing.
For age-restricted or otherwise regulated Products, customers may be required to provide evidence of eligibility or age as permitted or required by law.
- USER CONTENT, SELLER CONTENT AND REVIEWS
Users and Sellers may submit listings, Product information, photographs, reviews, comments, business details and other content (“User Content”).
You retain ownership of your User Content. By submitting User Content to LGV, you grant LGV a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format, resize, distribute and use that content as reasonably necessary to operate, promote and improve LGV and the relevant listing, Product or service.
You confirm that you have the rights and permissions necessary to submit the User Content and that it does not unlawfully infringe another person’s rights.
Reviews and feedback must reflect genuine experiences and must not be fabricated, misleading, defamatory, abusive, discriminatory, threatening, unlawful or posted in exchange for undisclosed incentives.
LGV may moderate or remove User Content where reasonably necessary for legal compliance, safety, platform integrity or enforcement of these Terms.
- INTELLECTUAL PROPERTY
The LGV website, branding, design, software, original editorial content and other materials created by LGV are owned by or licensed to LGV and are protected by applicable intellectual-property laws.
You must not copy, reproduce, republish, scrape, commercially exploit or create derivative works from LGV-owned content except where permitted by law or with our written permission.
Nothing in these Terms transfers ownership of a Seller’s or user’s intellectual property to LGV.
- THIRD-PARTY WEBSITES, TOOLS AND SERVICES
LGV may contain links to third-party websites, booking platforms, ticketing services, payment services, maps, social networks and other tools.
Those services are operated by third parties and may have their own terms, privacy policies and availability.
LGV is not responsible for the content, security or operation of a third-party service merely because it is linked from or integrated with LGV.
Stripe services are provided by Stripe under Stripe’s own applicable terms.
- PRIVACY AND PERSONAL INFORMATION
Our collection and handling of personal information is governed by our Privacy Policy.
Sellers who receive customer information through Shop Local must use that information only for legitimate order fulfilment, customer service, legal compliance and other purposes permitted by law. Sellers must not misuse, sell or improperly disclose customer personal information.
- SERVICE AVAILABILITY, ERRORS AND CHANGES
We work to keep LGV available and accurate but do not guarantee uninterrupted or error-free operation.
The Service may occasionally be unavailable due to maintenance, technical issues, third-party outages, security events or circumstances outside our reasonable control.
We may correct typographical errors, pricing display errors, broken links or inaccurate platform information when identified.
Where an error affects a completed transaction, we will deal with it consistently with applicable law and the rights of the affected customer or Seller.
- WARRANTIES AND CONSUMER RIGHTS
Except for rights, guarantees and remedies that cannot lawfully be excluded, LGV does not make additional warranties that the Service will always be uninterrupted, error-free or suitable for every user’s particular business purpose.
Nothing in these Terms excludes, restricts or modifies:
– the consumer guarantees under the Australian Consumer Law;
– liability that cannot lawfully be excluded or limited; or
– any other mandatory right or remedy available under applicable law.
- LIMITATION OF LIABILITY
To the maximum extent permitted by law, LGV is not liable for indirect or consequential loss arising solely from use of the platform, including loss of profit, opportunity or data, except to the extent such liability cannot lawfully be excluded or limited.
For third-party Seller Products, the Seller remains responsible for the Product and its supply to the customer.
LGV is not responsible for loss caused by information or conduct of a Seller, customer or other third party except to the extent LGV is legally responsible for that loss.
Nothing in this section excludes or limits liability where doing so would be unlawful, including liability arising from applicable consumer guarantees.
- INDEMNITY
To the extent permitted by law, a Seller agrees to indemnify LGV against third-party claims, losses, liabilities and reasonable costs arising directly from:
– the Seller’s unlawful Product or conduct;
– the Seller’s breach of these Terms;
– infringement of another person’s intellectual-property rights by content or Products supplied by the Seller; or
– the Seller’s failure to comply with obligations owed to a customer,
except to the extent the claim, loss, liability or cost was caused or contributed to by LGV.
This section is not intended to exclude rights or protections that cannot lawfully be excluded.
- SUSPENSION AND TERMINATION
You may stop using LGV at any time.
We may suspend or terminate access to all or part of the Service where reasonably necessary because of a material breach of these Terms, unlawful conduct, fraud or security risk, repeated non-payment or non-fulfilment, payment-provider restrictions, or serious risk to users or the platform.
Termination does not remove obligations that arose before termination, including outstanding orders, refunds, payment disputes, fees or other amounts lawfully due.
- CHANGES TO THESE TERMS
We may update these Terms to reflect changes to the Service, marketplace, law, technology or business operations.
The current version will be published on this page with an updated date.
Where a change materially affects existing Sellers or paid users, we will take reasonable steps to provide notice before the change takes effect where appropriate.
Continued use of the relevant Service after an updated version takes effect constitutes acceptance of the updated Terms, subject to any rights you have under applicable law.
- GOVERNING LAW
These Terms are governed by the laws of Victoria, Australia.
The parties submit to the courts and tribunals that have jurisdiction in Victoria, subject to any mandatory rights a consumer may have to bring a matter in another jurisdiction.
- SEVERABILITY AND ENTIRE AGREEMENT
If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
These Terms, together with policies and specific service terms expressly incorporated by reference, form the agreement governing use of the relevant LGV Service.
